Principal Sues Students Over Fake MySpace Profiles

Eric W. Trosch, a school principal in western Pennsylvania has sued four former students who he claims posted three parody MySpace.com profiles in 2005. The content Trosch claims damaged his reputation, humiliated him, and hurt his earning capacity included statements that he smoked pot, keept beer at school, liked having sex with students, watched pornography, and brutalized women.

The suit seeks punitive damages against what at least one defendant says is a First Amendment protected right. Also, a fourth profile, described as "the most graphic and lurid of them all", is still unattributed.

I don't think those students even have a case upon which to defend. From the ExpertLaw website, items that qualify as defamation include:

  • Attacks on a person's professional character or standing;
  • Allegations that an unmarried person is unchaste;
  • Allegations that a person is infected with a sexually transmitted disease;
  • Allegations that the person has committed a crime of moral turpitude;

The only real defense against libel and slander is truth - ie, the accusation must be true. So if these kids just think what they've done is a funny prank ... they're in for more than they think. The fellow that changed the content of John McCain's presidential bid MySpace page is facing legal actions for what he's done. I think the precedent goes in favor of the school administrator.

If the principal is so angered by this nasty prank, then maybe he should consider making a fake MY space account of the student.

Fake Student My Space say: "I like to watch Teletubby, my favorite one is 'Laa Laa'. I also like to buy Pokemon cards, and I still wet my bed everyday. And the reason why I never have a girlfriend is because......"
