German Court Upholds Sharia Law

A recent German court ruling has caused a firestorm of criticism both in Germany and abroad. A 26-year-old mother of two from Morocco filed for a speedy divorce from her abusive husband, also of Moroccan origin, in a Frankfurt court in October of 2006. German divorce laws generally require a year-long wait between separation and divorce except in the case of abuse, and the husband was not only abusive but also threatened the woman's life on numerous occasions. Judge Christa Datz-Winte, however, rejected the application for a speedy divorce, saying that the couple come from Moroccan culture, where it is common for men to beat their wives and is sanctioned by the Koran, the holy book of Islam. "You were raised in the Moroccan culture. Such situations could be considered normal in your culture," the Judge said, "According to the sura Nisa in the Koran, man has dominance over woman. So, there is no need for you to get divorced urgently."

Barbara Becker-Rojczyk, the woman's lawyer, decided to publish the Judge's decision, which was handed down in January after the court refused a request for a new judge. After the initial publication of the ruling on Spiegel Online, the attorney received a fax from the Frankfurt court granting the conflict of interest claim and excusing the judge from the case, although it is unlikely the case will be heard again before the mandatory separation is up. Numerous politicians in Berlin expressed outrage over the ruling and demanded disciplinary action against the judge.

I can't even begin to imagine what was in that judge's head.

It really doesn't matter what her former culture was - she was living in German culture, and asked the German courts for relief. If someone moved from Siberia and sued the landlord for turning off the heat, should the suit be dismissed because "they should be used to the cold"?

This criticism is richly deserved. The fact that Morocco might live in the 14th century doesn't mean Germany should. This is clearly a place where religion's so-called "rights" are trivially outweighed.

Germany, France and Europe as a whole will be gone, as we know it,in the next ten years. They have let the Muslims run over their culture and their lives. Fools! As for the Judge, she should be subjected to the righteous virtue of Sharia Law for failing her duty to uphold German principle and rule of Law as they prescribe it. She is a surely a danger to all things German.
