I have a hard time seeing how this fine could stand up in court. How does the officer (the only witness) know that the defendant was using a bummed wireless internet connection? It’s not like he shot him with his "wardriving radar."

My guess is that the inevitable legislation will end up regulating the wireless network owners (instead of the wardrivers).

"… fined him after exchanging a few words" My guess is the guy admitted it to the cop, not suspecting that it was illegal … "anything you say can and will be used against you in a court of law.;

While regulating the network owners would make more sense, I think criminalizing wardriving is more likely to occur, despite the problems with enforcement.
